General Website Use Policy

• Image Rights (who owns your pictures)
• All collaborative parties with My 1 of 1, inc. maintain rights to their images as they create designs on our platform and share to their other social media platforms from this website. My 1 of 1, inc. is not responsible for copyrights of your images or designs. My 1 of 1, inc. is also not liable for copyright infringement lawsuits against you.

• Design Rights (who owns your apparel designs)
• All collaborative parties with My 1 of 1, inc. maintain rights to the designs they created under their account on our platform and shared to their other social media platforms from this website. My 1 of 1, inc. is not responsible for copyrights of your images or designs. My 1 of 1, inc. is also not liable for copyright infringement lawsuits against you.

• Photo Consent of Release (agree to terms)
• All collaborative parties with My 1 of 1, inc. hereby release consent to use personal photos shared with affiliates of My1of1 for promotional content, video marketing, and creating a brand page for our 1of1 Entrepreneurs. Personal images and apparel designs no longer sold may still be used for marketing or promotion.

• Product Marketing (agree to terms)
• In order to remain eligible for marketing on our website, including Brand pages and product pages, 1of1 Entrepreneurs must sign the photo consent form. Without this form Phase II account status will remain locked and Phase III Marketing Consultations will be unavailable to you.

• Payment Breakdown (how you get paid)
• 1of1 Entrepreneurs will be paid 60% of the revenue produced through their brand page on my1of1.com after the cost of production has been deducted (see Payment Breakdown Sheet for costs of production). 1of1 Entrepreneurs will be paid bi-weekly via mailed check or direct deposit. 

• Program Progression Plan (agree to follow the phases)
• To maintain eligibility, 1of1 Entrepreneurs must agree to follow the progression plan as outlined in this packet. Parties in violation of the outlined progression plan are subject to termination of ‘1of1 Entrepreneur’ account status. The assigned account manager holds discretion for transitions between Phase II & III, based off of expert experience and market research.

• Tax Accountability (agree to accept responsibility) 
• 1of1 Entrepreneurs are self-employed consultants and are completely liable for their own taxes as such. All registered parties that make at least $600 are given a 1099 (self-employment form) to remain compliant with IRS policy and regulation. Please seek parental/legal counsel to appropriately file your annual taxes!

• Product Manufacturing (agree to terms)
• 1of1 Entrepreneurs have access to a streamlined manufacturing service. This service demands no up-front costs from 1of1 Entrepreneurs. The cost of production is deducted at the point of sale to purchase product for the order (see Payment Breakdown).

• Product Packaging (agree to terms)
• 1of1 Entrepreneurs have access to a streamlined packaging service. My 1 of 1, inc. produces and distributes your order in our mailers, made eco-friendly from 100% recycled materials. This service demands no up-front costs from 1of1 Entrepreneurs. The cost of production is deducted at the point of sale to purchase packaging for the order (see Payment Breakdown). Custom packaging is also available upon entering Phase III. Your style and design team will work with you to fully customize your packaging based on your brand’s needs.

• Product Shipping and Handling (agree to terms)
• Standard shipping and handling rates apply to all orders to you and your customers. Upon receipt of payment, My1of1 will provide you with a streamlined shipping service directly from our production facility to your customers. Similarly, your bulk and/or wholesale orders will be prepackaged and shipped directly from our production facility to you.

• Account Upgrades (agree to terms)
• Understand that promotion to ‘1of1 Entrepreneur’ account status as well as program phase transitions thereafter are considered account upgrades. Each account upgrade unlocks new commercial benefits for 1of1 Entrepreneurs and their brand pages. Once your account status has been promoted, it will remain intact unless your account violates these terms and conditions. My 1 of 1, inc. reserves the right to revoke the ‘1of1 Entrepreneur’ account status from any member at any time.

Phase I Upgrade: Access to style and design team

Phase II Upgrade: Access to wholesale price points/promotions 

 

• Account Management (agree to terms)
• Account manager oversees all aspects of your 1of1 brand page like your 1of1 Entrepreneur biography, brand logo, brand slogan, marketing campaign images, promotional codes, order fulfillment, product quality assurance, program phase transitions, and customer complaints. For issues regarding your assigned account manager, simply email info@my1of1.com to start your transfer to a new representative.

• Style and Design Team (agree to terms)
• Users who successfully enter Phase II of the 1of1 Entrepreneur program will gain access to a personal style and design team. This team services multiple accounts and is available through your account manager. The style and design team is responsible for coordinating the nuances of your brand page like product styles, product designs, product pages, and custom packaging. Users can consult live with their expert style and design team to discuss product designs, page content, and other marketing campaigns. Users in Phase II may schedule up to one free meeting monthly, while users in Phase III may schedule up to four free meetings monthly. Team meetings will be scheduled through your account manager as they fit into your team’s schedule. Reach out to your account manager as your first point of contact for issues regarding your assigned style and design team, or simply email info@my1of1.com to start your transfer to a new representative.

• Website/Software Development Team (agree to terms)
• As users enter Phase III, their team expands to include a website designer and/or software designer. This team is responsible for creating a [non-associated] Ecommerce platform, transferring digital brand content from my1of1.com, and establishing a communication system between your site’s administrative member(s) and your account manager. All additional requests regarding aesthetic design, technological integration, and other digital functionalities can be processed for a fee. Users in Phase III can consult with their expert development team through their account manager to discuss platform integrations, digital content displays, website design, and much more!  Reach out to your account manager as your first point of contact for issues regarding your assigned website and software development team, or simply email info@my1of1.com to start your transfer to a new representative.

Liability for Misuse 

• Copyright Infringement Liability (agree to accept responsibility)
• Parties caught infringing on the copyrights of others will be alerted and receive a corporate notice to cease and desist sales of the design(s) in violation. Failure to comply with corporate requests subjects users to termination of ‘1of1 Entrepreneur’ account status.

• Limitation of Liability (agree to terms)
• No provision hereof shall give rise to any liability of My 1 of 1, inc. for copyright or trademark infringement.
• In no event shall My 1 of 1, inc. nor any of its officers, directors and employees, be liable to you for anything arising out of or in any way connected with your use of this website and/or our 1of1 Entrepreneur program, whether such liability is under contract, tort or otherwise, and My 1 of 1, inc. including its officers, directors and employees shall not be liable for any indirect, consequential or special liability arising out of or in any way related to your use of this website and/or our 1of1 Entrepreneur program.

• Indemnification (agree to terms)
• You hereby indemnify to the fullest extent My 1 of 1, inc. from and against any and all liabilities, costs, demands, causes of action, damages and expenses (including reasonable attorney’s fees) arising out of or in any way related to your breach of any of the provisions of these Terms.

• Term Violations (violations of company policy)
• Violation(s) of terms will result in revoked ‘1of1 Entrepreneur’ account status. Termination of account status My 1 of 1, inc. reserves the right to revoke the ‘1of1 Entrepreneur’ account status from any member for any reason at any time. In the event that an account has been cancelled, all sales are nullified and the user forfeits the rights to collect on all future sales until the product is discontinued (see Contract Contingencies).

• Contract Contingencies (termination after breach of agreement)
• Failure to comply with the following terms may result in immediate account termination due to a breach of agreement. 
• Parties unwilling to comply with or in violation of the outlined program progression plan are subject to termination of their ‘1of1 Entrepreneur’ account status.
• 1of1 Entrepreneurs are sent a 1099 (miscellaneous income) form during Phase I. Users are responsible for their legal obligation to report their miscellaneous income over $600. 
• After being alerted in any way, users that fail to desist sales of designs that have infringed on the copyrights of another party are subject to termination of their ‘1of1 Entrepreneur’ account status.
• Users who fail or choose not to fill out the consent form for photograph/image release may be subject to termination of their ‘1of1 Entrepreneur’ account status.

Content Release

Release of Personal Information (agree to release your personal information)

• 1of1 Entrepreneurs agree to release anything written in their personal biography and other information like government name, age, location, and social media handles.

Photo Consent of Release (agree to release personal photos for marketing)

• 1of1 Entrepreneurs are required to sign a photo consent of release form. This gives My 1 of 1, Inc. the right to freely market the media content created for your brand page including your personal photos, apparel designs. My 1 of 1, inc. can use your content to market and promote at will, but will not extend this right to include ownership of your personal content (see Image Rights).

Cancellation Policy 

• Closing Accounts (how to close your account)
• If users are interested in closing their account they can process this request at any time with their account manager. By signing this document, you agree to participate in an exit interview to help us resolve any issues you may have had leading up to your account closure in order to close your account completely. Sales of user designs may continue unless directly asked to discontinue a product line. All sales of a once-active account are nullified until the product is discontinued (see Contract Contingencies).

• 1of1 Entrepreneurs are required to sign any and all revisions of this document. 1of1 Entrepreneurs who have made sales with an outdated updated contract, willingly opt to agree to new terms until otherwise stated. After being notified, users have a maximum of 7 days to reverse their decision to opt in, otherwise agreeing to the corporate-appointed terms and conditions. 
• In the event that an account has been cancelled, all sales are nullified and the user forfeits the rights to collect on all future sales until the product is discontinued.
